1. Acceptance

By accessing or using IndiaConsent, you agree to these Terms.


2. Service Description

IndiaConsent provides a platform enabling consent management between:

  • Data Principals
  • Data Fiduciaries

IndiaConsent acts solely as a Consent Manager.


3. Eligibility

Users must:

  • Provide accurate information
  • Use the platform lawfully

4. Account Responsibilities

Data Principals

  • Login via mobile number and OTP

Data Fiduciaries

  • Must register with accurate company details
  • Responsible for safeguarding login credentials

5. Responsibilities

Data Principals

  • Provide accurate mobile number
  • Review consent requests carefully

Data Fiduciaries

  • Ensure lawful processing of personal data
  • Provide accurate purpose and data usage details
  • Comply with applicable laws

6. Platform Limitations

IndiaConsent:

  • Does not verify legality of consent requests
  • Does not validate correctness of data usage
  • Does not control underlying personal data
  • Is NOT responsible for misuse of data by Data Fiduciaries

7. Prohibited Use

Users shall not:

  • Use the platform for unlawful purposes / fraudulent activities
  • Attempt unauthorized access
  • Misrepresent identity or company details
  • Misuse consent mechanisms
  • Attempt to breach system security

8. Service Availability

Service is provided “as is” and “as available” without guarantees of uptime.


9. Suspension and Termination

We may suspend or terminate access if:

  • Terms are violated
  • Legal requirements necessitate action
  • Security risks are identified

10. Indemnity

Users agree to indemnify and hold harmless IndiaConsent from:

  • Claims arising from misuse
  • Violations of law
  • Unauthorized data processing

11. Limitation of Liability

To the maximum extent permitted by law:

  • IndiaConsent shall not be liable for indirect or consequential damages
  • Total liability shall not exceed fees paid (if any)

12. Force Majeure

We are not liable for failures due to events beyond reasonable control.


13. Dispute Resolution

  • Governed by laws of India
  • Courts of Delhi shall have jurisdiction

14. Modifications

We may update Terms at any time.
